Is Driveway Sealer Toxic? Coal Tar, PAHs and What Is Actually Safe
One kind of driveway sealer has been banned by two states, a dozen counties and quietly dropped by every big-box chain. The others are far less of a concern but still not something to handle carelessly. Here is the honest split.

"Driveway sealer" covers two chemically unrelated products. One is a refined byproduct of coking coal that regulators have been steadily removing from the market. The other is essentially the same material as the driveway itself. Which one you are holding is the whole question.
1. The Short Answer
Refined coal tar sealer is the one to worry about. It contains polycyclic aromatic hydrocarbons, PAHs, at concentrations that are genuinely high, several of those compounds are classed as probable human carcinogens, and the dust that wears off a coal-tar-sealed surface has been traced into house dust, storm water and stream beds by federal researchers. That is why it has been banned across an expanding list of jurisdictions and why the big-box chains stopped stocking it.
Asphalt emulsion sealers, which are what you will find on the shelf at Home Depot, Lowe's and Menards under names like Latex-ite, Black Jack, Henry and the store brands, are a different product. They are made from the same petroleum asphalt as the driveway, suspended in water. Their PAH content is a small fraction of coal tar's, the fumes are mild, and once cured they are about as inert as the pavement underneath. They are not something to drink, bathe in or let a toddler crawl through while wet, but used with ordinary care they are not a meaningful health concern.
Acrylic and polymer-modified sealers are lower still in PAHs and are the usual choice where local rules are strictest. The rest of this article explains the evidence behind that ranking, how to find out which type you have, and the practical precautions that apply to all of them.
2. The Coal Tar Problem
What It Is
Coal tar is what is left when coal is heated in the absence of air to make coke for steel production. Refined coal tar pitch, the grade used in pavement sealers under specifications such as RT-12, is a dense black material that happens to be exceptionally resistant to petroleum. That is precisely why the industry liked it: gasoline and oil drips that dissolve an asphalt-based coating sit on a coal tar coating and wipe off. For decades it was the professional's default sealer, especially on commercial lots and in the eastern and midwestern United States.
The PAH Numbers
PAHs are a family of compounds formed whenever organic material burns or is heated without enough oxygen. Coal tar is largely made of them. Refined coal tar sealers typically contain PAHs on the order of 50,000 milligrams per kilogram, which is five per cent of the product by weight. Asphalt emulsion sealers typically contain around 50 milligrams per kilogram. That is the source of the widely quoted figure that coal tar sealers carry roughly a thousand times the PAH content of asphalt-based sealers. Several of the individual PAHs involved, benzo(a)pyrene being the best known, are listed as probable human carcinogens by the US EPA and the International Agency for Research on Cancer, and coal tar pitch itself is classed as a known human carcinogen in the occupational context, where workers have been exposed to it at high levels for years.
What the USGS Found
The research that shifted the conversation came from the US Geological Survey, beginning with work in Austin, Texas in the early 2000s. City staff had noticed unusually high PAH levels in stream sediment and, on investigation, traced them to parking lot runoff. The USGS then established, across a series of studies, that coal tar sealcoat is the dominant source of PAHs in urban lake and stream sediments in many parts of the country, that a sealed surface sheds a meaningful proportion of its coating as fine dust within the first few years, and that this dust does not stay outside. Their work found PAH concentrations in house dust from apartments adjoining coal-tar-sealed parking lots that were many times higher than in homes next to unsealed or asphalt-sealed lots, and they estimated that for small children, who spend a lot of time on floors and put their hands in their mouths, ingestion of that dust could represent a substantial fraction of their PAH exposure.
It is worth being precise about what that does and does not say. It is evidence of elevated exposure, and PAHs are compounds that toxicologists have good reason to want people exposed to as little as possible. It is not a body count, and the risk estimates involved carry all the uncertainty that lifetime exposure modelling always does. But it was enough for a number of state and local governments to decide the trade-off was not worth it, and we think they were right. The oil resistance of coal tar is a real advantage, and it is not remotely worth a thousandfold increase in a probable carcinogen tracked across your kitchen floor.
Fumes and Skin
Anyone who has applied coal tar sealer on a hot day will tell you the fumes are unpleasant in a way emulsion is not. The volatile fraction includes naphthalene and other light PAHs, which irritate eyes and airways and give some people headaches. Skin contact with wet coal tar sealer can cause irritation and, more distinctively, photosensitisation, where the exposed skin burns far more easily in sunlight for a day or two afterwards. Contractors who work with it daily know to cover up completely. Homeowners doing it once a year often do not.
3. Bans, Withdrawals and Where It Still Sells
Austin banned coal tar sealcoat in 2006, the first jurisdiction in the country to do so, following the stream sediment findings. Washington DC followed in 2009. Washington State enacted a statewide ban that took effect in 2012, and Minnesota's statewide ban took effect in 2014. Since then a long and growing list of counties and municipalities have adopted their own, concentrated in Illinois, Wisconsin, Minnesota, Maryland, New York, Texas and the Great Lakes region generally, along with a number of individual cities elsewhere. Several states have considered wider bans without yet passing them, and the position changes often enough that it is worth checking your own county's stormwater or public health pages before assuming either way.
Retail moved faster than legislation. Home Depot stopped selling coal-tar-based sealers nationwide around 2011, and Lowe's did the same shortly after, replacing them with asphalt emulsion and acrylic lines. Ace Hardware and several regional chains followed. The practical effect is that the pail a homeowner picks up at a big-box store today is almost certainly not coal tar, regardless of where they live. Where coal tar persists is the contractor supply chain. Sealcoating contractors in states without a ban can still buy it in bulk from regional manufacturers, and some still prefer it for its oil resistance and durability. 4. Asphalt Emulsion, Acrylic and "Eco" Claims
Asphalt Emulsion
Asphalt emulsion sealer is petroleum asphalt, the same binder that holds the driveway together, dispersed in water with emulsifying agents, clay fillers and usually some latex or polymer for flexibility. Its PAH content is low because petroleum asphalt is a fundamentally different material from coal tar, made of much heavier and less aromatic hydrocarbons. When you open the pail it smells like a freshly paved road, the fumes are mild and dissipate within hours, and there is no significant volatile PAH fraction to worry about in normal outdoor use.
That said, wet emulsion is not harmless. It is alkaline, it will irritate skin with prolonged contact, it is very difficult to remove from skin, clothing and anything porous once it starts to set, and it should not go anywhere near your eyes. The clay and asphalt fines that wear off a cured emulsion surface are not the concern that coal tar dust is, but they still come into the house on shoes and paws, and they still wash into storm drains, which is one reason stormwater agencies would rather nobody sealed at all. Acrylic and Polymer Sealers
Acrylic sealers use synthetic resins rather than asphalt as the binder, sometimes with a small asphalt component for colour. They have the lowest PAH content of the three, cure fastest, and are the product of choice where local rules are tightest or where a coloured finish is wanted. What "Eco" and "Low VOC" Actually Mean
Be a little sceptical of marketing here. "Coal tar free" is a real and meaningful claim and it is the one that matters. "Low VOC" is also real; most water-based emulsions and acrylics have low volatile organic compound content because the carrier is water, and it is genuinely better for air quality than solvent-based products. "Eco-friendly", "green" and "environmentally safe" are not regulated terms and tell you nothing specific. Every asphalt emulsion sealer is a petroleum product that you are spreading over several hundred square feet of ground that drains to a storm sewer. It is a lower-impact choice than coal tar by a very wide margin. It is not a zero-impact one, and any label implying it is should make you read the Safety Data Sheet more carefully, not less.
5. How to Check What You Have
If you have a pail in the garage of uncertain origin, or a contractor has quoted you a job, here is how to establish what it is.
Read the Safety Data Sheet
Every sealer sold in the US has a Safety Data Sheet, and manufacturers publish them online; search the exact product name plus SDS. Section 3, composition, lists the hazardous ingredients. Coal tar products will list coal tar, coal tar pitch, refined coal tar, or refined tar, and they will carry the CAS registry number 65996-93-2, which is the identifier for coal tar pitch. Some older data sheets reference the RT-12 specification. If you see any of those, it is coal tar. Asphalt emulsion products will list asphalt or petroleum asphalt, typically with CAS number 8052-42-4, along with water, clay and polymers.
Read the Front of the Pail
Because "coal tar free" has become a selling point, most emulsion and acrylic products now say so prominently. Coal tar products, conversely, often say "refined tar" or "coal tar emulsion" in small print on the back and lean on words like "professional grade" and "gas and oil resistant" on the front. Exceptional oil resistance in a sealer sold at an ordinary price is itself a hint, because it is the one thing coal tar does that emulsion cannot match.
Ask the Contractor
Ask what product they use and ask to see the SDS. A reputable sealcoating outfit will have it in the truck or can email it in minutes. If the answer is vague, or "it's just sealer", either press for the manufacturer and product name or move on. In a jurisdiction with a ban, using coal tar is also illegal, which is a useful additional lever.
If It Is Already on Your Drive
A coal tar sealed drive is not an emergency, and ripping it up would release far more dust than leaving it. The practical mitigations are to sweep rather than pressure wash so you are not blasting fines into the storm drain, to take shoes off at the door, to keep kids from playing on the surface, and, when it is due to be resealed, to overcoat with an asphalt emulsion or acrylic rather than more coal tar. 6. Practical Safety During and After
These apply to any sealer. Most of them are basic, and most of them are skipped by most homeowners most of the time.
Gloves and Eye Protection
Nitrile gloves, not the cotton work gloves that soak through in five minutes. Wet sealer is alkaline and irritating, it will not come off skin with soap, and you do not want to find out how well it comes out of an eye. Wrap-around safety glasses are worth wearing whenever you are pouring or squeegeeing, because a splash from a dropped pail travels further than you would think. Long sleeves and trousers you do not mind ruining. Old boots you will never wear indoors again.
Fumes and Ventilation
Sealing is an outdoor job and the ventilation problem mostly solves itself, but a few situations catch people out. Do not seal a garage floor or a carport with the door down. Do not stand downwind of a large freshly-coated area on a hot still afternoon for hours at a time. If you are using coal tar, apply with the wind at your back and take a break in fresh air if your eyes sting or you feel light-headed. For emulsion, a headache from the smell is unusual but not unheard of on a very hot day, and it is a signal to step away. A basic respirator with organic vapour cartridges is not necessary for emulsion in the open but is a sensible precaution with coal tar.
Skin Contact and Washing
Wipe wet sealer off skin immediately with a rag and then wash with soap and warm water. If it has started to set, a little mineral oil, baby oil or a citrus-based hand cleaner will lift it; do not reach for gasoline or paint thinner, which is a common and bad idea that replaces one exposure with another. Shower when you finish the job, and wash the clothes separately or bin them.
Kids and Pets
Keep both off the drive for a minimum of 24 hours in warm dry weather and 48 hours if it is cool, humid or shaded, or if the coat went on heavy. "Dry to the touch" is not the standard; the coating is still soft for a day or more after that and small feet pick up residue that goes onto carpets, into beds and into mouths. Dogs in particular walk through it, lick their paws, and then you are on the phone to a vet. Tracking Into the House
For the first week or two after sealing, especially with emulsion, some fines will come off on shoes. Take them off at the door. This matters most in a house with a crawling baby, and it matters far more if the sealer is coal tar, where the dust is the primary exposure route the USGS identified. A doormat and a shoes-off rule for a fortnight cost nothing.
Pregnancy
We are not aware of a study specifically on driveway sealing and pregnancy outcomes, and we are not going to invent one. What we can say is that PAHs are compounds most guidance advises minimising exposure to during pregnancy, and that sealing a driveway is a job that can be done by someone else or postponed. On that basis the reasonable precaution is for a pregnant person to skip the application and stay clear of the fumes, which for emulsion means a few hours and for coal tar means the rest of the day. That is a common-sense position rather than a medical claim.
7. Disposal, Runoff and Wells
Leftover Product
Never pour sealer down a sink, toilet, storm drain or onto soil. That is the one absolute rule. For a part-used pail of asphalt emulsion, most municipalities are happy for you to leave the lid off somewhere sheltered until the contents dry solid, then put the pail in household waste; the dried material is inert enough for landfill and the pail is no longer a liquid hazard. Adding cat litter or sawdust speeds the drying. For coal tar product, take it to your household hazardous waste facility, and do the same for emulsion if your local authority asks for it; the rules vary by county and a two-minute search of your county's waste pages will tell you. Unopened pails can often be given to a neighbour or a local buy-nothing group, which is better than either option.
Tools and Rinse Water
Rinse squeegees, brushes and rollers in a bucket, not under the hose in the street. Let the bucket sit until the solids settle and the water evaporates, then dispose of the dried residue with the rest. A cheap roller cover is not worth cleaning; let it dry and bin it. Wash-down water from cleaning tools is one of the most common ways sealer ends up in a storm drain, and it is entirely avoidable.
Rain and Runoff
Storm drains in most US neighbourhoods do not go to a treatment plant. They go to the nearest stream. Wet sealer washed off by an unexpected shower goes straight there in a black slick, and this is the acute version of the chronic sediment problem the USGS documented. Do not seal with rain in the forecast for at least 24 hours, and preferably 48, and check the radar again before you open the pail. Keep the product itself well back from any drain grate, swale or ditch, and if the drive runs down to the street, stop the coat a foot short of the gutter rather than flooding into it.
Wells and Septic
If you are on a private well, keep sealer, rinse water and runoff well clear of the wellhead and any surface drainage that leads toward it. The risk from a properly applied emulsion sealer is small, but wells have no treatment step, and there is no reason to test it. Do not clean tools anywhere near a septic drain field either; the solids and the alkalinity are both unwelcome there.
Should You Seal at All?
Some stormwater agencies would answer no, and it is a fair question. Sealing an asphalt drive protects the binder from UV and water and extends its life; it also puts a few gallons of petroleum product onto an impervious surface every couple of years. Our view is that it is worth doing with an emulsion or acrylic product, applied thin, in dry weather, with the precautions above, and that the honest trade-offs are laid out in sealing an asphalt driveway: pros and cons. Common Mistakes
Assuming all "sealer" is the same stuff
Coal tar and asphalt emulsion differ in PAH content by roughly a thousand times. Check the SDS for CAS 65996-93-2 before you buy, or before a contractor sprays.
Letting kids and dogs back on when it looks dry
Dry to the eye is not cured. Give it 24 to 48 hours and the thumb-press test before small feet and paws carry it into the house.
Hosing tools off in the street
The storm drain goes to a stream, not a treatment plant. Rinse in a bucket and let it dry out.
Cleaning skin with gasoline or thinner
You have swapped an alkaline irritant for a solvent that goes straight through skin. Use mineral oil or a citrus hand cleaner, then soap.
Trusting "eco" on the label
Only "coal tar free" means something specific. Everything else is marketing. Read section 3 of the data sheet.
Frequently Asked Questions
Is driveway sealer toxic?
It depends on the type. Refined coal tar sealers contain very high concentrations of polycyclic aromatic hydrocarbons, several of which are probable human carcinogens, and their dust has been linked to elevated PAH levels in homes and streams. Can driveway sealer contaminate a well or storm drain?
Wet sealer washed off by rain runs straight into storm drains, which discharge untreated to local streams, and coal tar runoff in particular has been measured in stream sediments. Never seal with rain forecast, keep product away from drains and swales, and if you are on a well, keep sealer well clear of the wellhead and any drainage that leads to it.

The Bottom Line
Coal tar sealer is the toxic one. Its PAH content is roughly a thousand times that of asphalt-based sealers, federal researchers have traced its dust into homes and streams, and a growing list of states and cities have banned it. Check the data sheet for CAS 65996-93-2 and do not use it, whatever a contractor says about oil resistance.
Asphalt emulsion and acrylic sealers are a different matter. Treat them like any petroleum coating: gloves, eye protection, open air, kids and pets off for a day or two, nothing down the drain, and no application with rain coming. Do that and sealing a driveway is a low-risk job.
